A Victorian agent has been ordered to serve 200 hours of community service after illegally claiming a First Home Owner Grant (FHOG), despite already owning a house.
Director of Buxton Ashburton and Oakleigh Robert Eierweis pleaded guilty at Moorabbin Magistrates Court to two charges of making a false statement in an application - one count of failing to repay the amount of a grant and one count of tax evasion.
The Moorabbin Kingston Leader, State Revenue Office prosecutor Yana Podolskaya told the court, Mr Eierweis had claimed a $16,000 First Home Owner Grant for a $510,000 Chadstone house in August 2009.
However, he had purchased his parents’ Moorabbin house a month earlier, and a property in St Kilda in 2005.
Ms Podolskaya told the court successful grant applicants must not have owned or "held a relevant interest in" a residential property.
Magistrate Thomas Barrett did not convict Mr Eierweis.
Mr Eierweis declined to comment, telling Real Estate Business the matter had been dealt with by the court.
