A director of a Gold Coast agency allegedly under paid three staff by more than $53,000, prompting the Fair Work Ombudsman to take action against the principal.
Total Property Group and managing director Adrian Parsons allegedly underpaid three real estate salespeople a total of $53,222 between October, 2009 and February 2011.
According to the Ombudsman, a majority of the underpayments are the result of the employees being significantly under paid the sales commissions they were entitled to, as well as minimum weekly wages and annual leave entitlements.
It is alleged the employees were under paid individual amounts of $32,951, $16,551 and $3,720.
Fair Work Ombudsman group manager Michael Campbell said the significant amount involved and the failure to rectify the alleged underpayments were key factors in the decision to prosecute.
Mr Parsons faces penalties of up to $6,600 per breach and the company faces penalties of up to $33,000 per breach.
The Fair Work Ombudsman is also seeking a court order for back payment of the employees. A directions hearing is listed in the Federal Circuit Court in Brisbane on May 6.
Real Estate Business attempted to contact Total Property Group and Mr Parsons, however he had not responded by the time of publication.
