NSW Fair Trading has handed down a major ruling following an investigation into Australia’s top-selling agent, just days after the principal split from Ray White.
Australia’s top-selling real estate agent, Josh Tesolin, has been suspended from trading for 120 days by NSW Fair Trading.
The suspension, which took effect on Friday, will remain in place until 6 December 2025, according to Service NSW records.
The Daily Mail reports the alleged breaches include underquoting on more than 100 properties, dummy bidding, and producing false documents.
The decision comes just over a week after Tesolin split from Ray White and rebranded his Western Sydney agency as NGU Quakers Hill - The Tesolin Group.
Tesolin, a five-time recipient of RateMyAgent’s #1 Agent title, was the subject of a Fair Trading investigation launched earlier this year following complaints against him and then Ray White Quakers Hill.
Underquoting has been illegal in NSW since 1 January 2016, when reforms that were created to stop real estate agents from understating property prices were introduced to the “Property Stock and Business Agents Act (NSW) 2022”.
Earlier this year at a Parliamentary committee meeting, Minister for Better Regulation and Fair Trading Anoulack Chanthivong said that underquoting had been a priority focus of the Strata and Property Services Taskforce to lift the sector standards.
Chanthivong noted that 379 inspections into underquoting were conducted in NSW during FY2023–24, resulting in 148 identified breaches that led to approximately $143,000 worth of penalty infringement notices.
