Victorian agent faces criminal charges

Victoria’s consumer affairs commissioner has commenced action against an estate agent located in Port Melbourne.

Following charges laid by Victoria Police for alleged criminal offences, the state’s consumer affairs office has moved to take further action against Joshua Allison.

Mr Allison, 41, is the sole director and officer in effective control of Josh Allison Enterprises and has operated as an estate agent and agent’s representative in association with this company.

The consumer affairs director Nicole Rich suspended the licences of Mr Allison and his company in February, under the Australian Consumer Law and Fair Trading Act 2012, after being alerted that Victoria Police had charged Mr Allison with criminal offences.

Mr Allison will face the Victorian Civil and Administrative Tribunal (VCAT) to determine whether he has breached the Estate Agents Act 1980 and related regulations by:

  • Engaging in conduct that is unprofessional and detrimental to the reputation or interests of the estate agent industry
  • Acting in a way that is not of good character, and not a fit and proper person to hold an estate agent’s licence

Mr Allison appeared at a directions hearing on 16 May. The consumer affairs case has been adjourned, pending the outcome of the criminal proceedings that Mr Allison is facing.
